IMPORTANCE The Capper-Volstead Act authorizes the associations of producers of agriculture products. It allows farmers to lawfully unite or network to collectively market their products.
BACKGROUND Prior to Congress passing the 1922 Capper-Volstead Act, farmers were being prosecuted under antitrust laws for acting together to market their products. The act authorized various kinds of agricultural producers to form voluntary co-operative associations for purposes of producing, handling and marketing farm products. The law also gave the Secretary of Agriculture power to prevent such associations from achieving and maintaining monopolies. The secretary could hold hearings, determine facts and issue orders ultimately subject to review by federal district courts.
NPPC POSITION NPPC continues to be diligent against encroachment on agricultural producers’ legal rights to act as cooperatives or networks under the provisions of the Capper-Volstead Act, which could be key to the future of independent pork producers in the future.
